Warranty Information

THIS IS A LEGALLY BINDING CONTRACT BETWEEN YOU, THE BUYER, AND TMAC COMPUTERS WHICH COVERS THE PURCHASE YOU ARE ABOUT TO MAKE. PLEASE READ IT CAREFULLY IN ITS ENTIRETY BEFORE MAKING ANY PURCHASE.

Acceptance of your order
All orders placed on our web sites are subject to acceptance by TMAC Computers. Orders are not deemed accepted until the products are shipped. All orders are subject to cancellation or rejection by TMAC for any reason. and we reserve the right to ship less than the quantity ordered without prior notice.

Prices & Payment
All items and prices listed on TMAC web sites are subject to change without notice to you. At present payment methods accepted are Personal Check ( we will hold all orders paid by personal check until the check clears ), Certified Check or Money Order. Payment by major credit cards will be accepted at sometime in the near future. We are proceeding carefully in establishing a merchant account in order to keep our prices to you as low as they can possibly be.  Paying by credit card may add 2% to your purchase. Please make sure all billing and address information is entered correctly. Any error may cause delay in the shipment of your purchase. Larger orders are subject to additional verifications and information. Sales and other applicable taxes will be added where and when applicable.

Risks & Shipping
You will be charged applicable shipping, handling and insurance charges. Please see our No Profit Shipping Policy. If you received a product with apparent damages, please file a claim with the carrier immediately and request an inspection by the carrier. All risks associated with the delivery of your purchases shall be borne by you as soon as the purchased products are delivered to the carrier.

TMAC ships only within the United States. For all orders shipping to Alaska, Hawaii, APO, FPO and any US Territories shipping costs are different. TMAC will E-Mail you these costs for approval before shipping the merchandise. Please note, an accurate email address is extremely important. we use this email address to send your order status, and shipping confirmation.

We will always attempt to ship your order immediately, sometimes though it can take up to 2 business days upon verification of funds and availability of product. Therefore, please allow 2 business days for an order to be processed and shipped, after approval of funds, this includes any UPS 2nd Day, US Mail and UPS Ground packages. Our orders are processed during our business hours Monday - Friday.

Allow 7-10 Working days for UPS Ground Service, 3-4 working days for UPS Express Service, excluding holidays & weekends.

TMAC Limited Warranty
This limited warranty is extended only to the original person or origination who purchases products from TMAC. Should your purchase prove defective by reason of improper workmanship or material under normal use and service conditions within 1 year from the date of the invoice, TMAC will repair, or at its option, replace the defective product in accordance with OUR RMA (Return Merchandise Authorization) Policy. TMAC will further provide repair at cost of parts with no labor charges for the second year of ownership by the original purchaser. TMAC also warranties, as long as practical, a three working day turn around on all warrantee issues.

This limited warranty does not cover incompatibility with other hardware and software, (for instance a 4 Gig hard drive cannot always be made to work with a 486 class motherboard) products damaged by accident, improper installation, misuse, lightening, irregular power, fire, water, acts of war or other acts of nature; or parts and equipment altered or repaired by anyone not authorized by us. Buyer will not be reimbursed for any repair, parts replacement, set-up, maintenance, checks, tests, configuration, consultation, shipping costs, depreciation, reduction in price or any other charges related to the products purchased from or on our web sites.

With regard to SURPLUS, USED, or AS IS merchandise all products have a 7 day DOA warranty from date of receipt of product unless otherwise stated on our Website. If product is found to be defective an exchange will be given and shipping charges will be assumed by TMAC for the return to you. If product is found not to be defective a 20% handling fee will be charged in addition to shipping charges. The product will be shipped back after receipt of  shipping charges & 20% handling fee.

DISCLAIMER AND LIMITATION TO TMAC
Should any product purchased from us prove defective, the buyer's sole remedy shall be repair, replacement, and credit or refund as determined by TMAC. In no event shall we be liable for any loss of use, loss of revenues or anticipatory profit or any direct, indirect, consequential, special or punitive damages arising out of or connected with the sales, use, interaction or inability to use any product sold by TMAC.

TMAC makes no representations or warranties either expressed or implied with respect to any of the products, including without limitation, any expressed or implied warranty of merchantability or fitness for a particular purpose. The TMAC Computers Web Site and the information provide therein are provided on an as is basis and TMAC makes no representations or warranties, either express or implied, of any kind. All information and contents therein, Y2K compliance or accuracy of content, TMAC expressly disclaims any and all warranties, express or implied. 

TMAC's liability of any kind for any loss or damages arising out of, or resulting from any product sold or purchased on TMAC's web sites or TMAC, shall in no case exceed the purchase price of the specific product or service which gives rise to the claim. Any such liability shall terminate upon the expiration of the warranty period specified herein.

RMA Policy
The original buyer may return any defective product purchased on TMAC web sites or from TMAC within the warranty period under the following conditions:

1. Obtain an RMA number from Customer Service by furnishing the date and number of the invoice, description of all items returned, model and serial number and reason for requesting a RMA number.

2. Within 7 days of the issuance of the RMA number, ship the returning products freight pre-paid and insured for the full purchase price and using only the original boxes and packing materials. All accessories, software, cables, manual and other items supplied with your purchased must be returned.

3. All products returned must have the RMA number prominently displayed on the shipping label. All boxes without the RMA number prominently displayed on the shipping label will be automatically rejected.

4. It is buyer's responsibility and risk to ensure all returned products will be received by TMAC all accounted for and undamaged.

5. All returned products must be in their original and undamaged condition.

6. All products returned that are not defective will subject the buyer to applicable charges.

Law & Jurisdiction
You agree that any legal action between you the buyer and TMAC shall be governed by the laws of MAINE without regard to the principals of conflict of law and must be filled with an appropriate and competent court located within Kennebec County, Maine.

Other Terms and Conditioins
A 20% Restocking fee will be charged for all orders returned within 72 hours (Three days). After 72 hours returns will be for replacement of defective merchandise only in accordance with our RMA policy.

Monitors diagonal measurement is based on CRT size and is determined by manufacturer.

Maine orders add 5% sales tax.
